CBS Early Show co-host Harry Smith asked former Republican Congressman J.D. Hayworth this ridiculous question: “Some people would contend that this law in Arizona is racist in nature. Some have equated it even with Jews having to carry identification during Nazi Germany. How do you respond to that?”

Some people contend a lot of things without a shred of evidence.

The full text of the law can be found HERE.

A law enforcement officer can only arrest a person if the officer HAS PROBABLE CAUSE TO BELIEVE THAT THE PERSON HAS COMMITTED ANY PUBLIC OFFENSE THAT MAKES THE PERSON REMOVABLE FROM THE UNITED STATES.”

The law “SHALL BE IMPLEMENTED IN A MANNER CONSISTENT WITH FEDERAL LAWS REGULATING IMMIGRATION, PROTECTING THE CIVIL RIGHTS OF ALL PERSONS AND RESPECTING THE PRIVILEGES AND IMMUNITIES OF UNITED STATES CITIZENS.”

The Arizona illegal immigration law is an enforcement law. Meaning, it simply requires local law enforcement officials to be in compliance with federal immigration laws. Period. There is no ’rounding people up off the streets’. These kinds of assertions are completely false. Additionally, legal immigrants are required to carry their ‘papers’ - a requirement signed into law by FDR.

President Obama weighed in on the controversy by making the bizarre comment: “Indeed, our failure to act responsibly at the federal level will only open the door to irresponsibility by others. And that includes, for example, the recent efforts in Arizona.”

No Mr. President, it is not “irresponsible” to take responsibility for a job the federal government is supposed to be doing but isn’t. Controlling the borders is one of the few functions the federal government is actually supposed to do, not take over health care.

And what of the Border Patrol? Should they try to stop or catch illegal crossings? If the answer is yes, then why should that purpose cease after an illegal alien reaches a city?

It’s interesting to hear people say they are in favor of enforcing the current immigration laws, but are against this enforcement law. It would be similar to saying, “yes, I’m in favor of laws we don’t enforce.” It makes no sense, but it shows how misinformed people are thanks to the establishment pro-illegal immigration media.

  1. Marge Snowe says:

Isn’t this law basically a copy of existing federal law? Obviously the people of Arizona are alarmed at the rate of illegal immigrants that are spilling over their border with Mexico into the state. So what are they to do? Just sit back while the whole state implodes? It is clear the feds have no intention of honoring their duty to secure the border. So Arizona has to take these measures. It is a sad situation all around.

  2. It’s a shame to see the people and businesses of Arizona effected by this. It’s the politicians fault, not the peoples. We all elect fools for politicians.
