
The Senate confirmed Elena Kagan Thursday as the Supreme Court’s 112th justice and fourth woman. Reports have praised her confirmation as one of “selecting a scholar with a reputation for brilliance, a dry sense of humor and a liberal legal bent.” Calling her a brilliant scholar is a bit of stretch to say the least.
She was just a dean for a law school and never served as a judge, and from what can be discerned, has a judicial philosophy that is contrary to judicial restraint. While her confirmation does not alter the ideological bent of the court, she’s still another far-left ideologue and thus a judicial activist. This means that on most issues of government versus people, she will side with government.
Sen. Chuck Schumer, D-N.Y., said, “average Americans will be a step closer to once again having their voices heard in the highest court in the land.” Average Americans? People with lives in academia and government know only a world of perpetual paychecks without accountability. They cannot understand Middle America and often have nothing but contempt for the average citizen. Elena Kagan has a background that includes Manhattan’s Upper West Side, to Princeton University, and on to Harvard Law School. Arrogant elitists almost never side with average Americans on anything.
